named Psons or others we declare & Protest that we are not C. P. willing to be transported in manner afd Unless the same be really & truly legall & Sufficient and wheresoever the said Commission or Ordr shall be found insufficient to the Effect afd in any action or actions that may hereafter be maintaind agt the said Prisoners & others for such their Illegal transporta tion of us We do protest that then & in tht Case may be lookt upon in Construction of Law as unwilling and forceable transported and we do Protest further that we in no ways receed from our Petition formerly sent by us to his Majesty praying Transportation and lastly we do Protest that the Agreemt or bargain made by us with the aid Psons or any of them or others for our good usage in our Transportation and for our liberty at end of our voyage shall not debarr us from maintaining an Action or Actions agt all or any the afore named psons and others for their illegal transporting of us and such others as adhere to this our Protestation and we Pro test in manner afd that any such bargain made was only for preventing the severities we justly apprehended might be Ex ercis'd on us on Ship board dureing our voyage and for preventing Imprisonmt & Confinemt in those parts to which we are to be transported both which were threatned by the aforenamed Psons & Contraveeners of the said Act in Case of our refusall to make Agreemt with them for Civill Usage and liberty at the end of our Voyage John Chalmers.
Resolved and Ordered that a proclamation Issue declaring whosever setts free any of the afd Rebbells transported into this Province shall give security for their abideing within this Province and be of good behaviour for the Term of Seaven years as follows.

A Proclamation
Whereas there has been transported into this Province by his Majtys Royall Comand fifty five psons most of them Scott men taken in the late rebellion at Preston & imported in the Ship the Good Speed of Liverpool whereof Arthur Smith is Comander concerning whom his Majty has been graciously pleased to Signify to me by letter from the right honble James Stanhope Esqr One of his Principall Secretarys of State dated at Whitehall the fourth day of May last that it was his royall pleasure that the rebbells so taken & Im ported as afd should either enter into Indentures to serve such
