     be granted unto me by his sd Majesty's Commission or Com-         Lib. W. B.

     missions I will not for ffear ffavour or Affection or any other

     Cause hinder or delay Justice to any but will truely Execute

     the said Office and Offices respectively according to his Maty

     Commission to me in that Behalfe and to the true intent &

     meaning thereof and not otherwise to the best of my under

     standing and Judgernent; I will not know of any attempt

     against his sd Majesty's Person his Rights or Dorninions in

     to or over the said Province and the People therein, But I will

     Prevent Resist and oppose it to the utmost of my Power and

     will make the same knowne wth all Convenient Speed to his

     said Majesty And I will in all things from tyme to tyme as

     occasion shall require faithfully Counsell and Advise his said

     Majesty according to my Heart and Conscience.

       After which his Excellency declared that notwithstanding

     he had received a Commission from the Right Honble the

     Lord Charles Barron of Baltemore and the Lord Francis             p. 52

     Guilford his Guardian to be Lieutenant and Cheif Governr of

     this Province, Yet He had not had the least Instruction or

     notice of the Government being by his Majesty restored to

     my Lord Baltemore. And having produced the sd Com

     mission dated the 30th of May 1715. Ordered the same to be

     read at the Board which was so done. And then desired the

     Members of the Board Severally to give their opinions

     Whether it be advisable for his Excellcy to Accept of and Act

     by the said Commission without some particular Instruction

     direction or Notification from his Majesty or other Legal

     notice that he has been graciously pleased to restore the

     Governmt to the Lord Proprietor since his Excellency now

     Administers the Governmt by Virtue of his Majesty's Royal

     Authority under the Great Seale of Great Britain and accord

     ing to the Oath before recited.

       The Board are unaminously of Opinion that as his Excel

     lency has declared he has not received any Instructions or

     Notice from his Maty or any legal Authority derived under

     him of his Pleasure to restore this Government to the Lord

     Proprietary He ought not to accept of or Act by the said

     Commission or any ways resigne up the Administration of the

     Government he now holds under his Majestys Authority untill

     his Majesty's Pleasure is signifyed to him for so doing.

       His Excellency having received a Letter from the Honble

     Col Alexandr Spotswood of the fifteenth of July last com-         p. 53

     municated it the Board as followeth viz.

       Last night I received the Honour of Yours of the tenth

     Instant with a Pacquett Inclosed from South Carolina; I can-
