of Room as if they were of an equall size which is a great Lib. C. B. Discouragement of the Navigation of this Kingdorne. The second Law, to prevent Cropping, Cutting and De facing of Tobacco Hogsheads &c. Enacts That Every Masrs of a Ship, taking Freight shall Give Bond with one surety in the sum of two hundred pounds sterling, that he [will] Not for p. 132 that Voyage, Cut, Crop, lessen, Disminish, Deface impair any Tobacco Hogsheads, taken on Board his said Ship, or suffer the same to be Done under the penalty of three pounds ster ling for Every Hogshead so Defaced. This the merchants complains of, as an other hardship upon them; for the penalty upon those that shall make the Hogs- heads larger than the Size in the aforementioned Act is to forfeit but one hundred pounds of Tobacco, amounting to about six shill ; whereas the penalty for Defacing or Endam aging a hogshead in the stowing, being three pounds Sterling, is more than the value of a Hogshead of Tobacco there, which the said Comrs conceive to be unreasonable, for the large size of the Maryland Hogsheads obliges the masters to vse screws to squeeze them in their stowage, which is lyab!e to be interpreted a Defacing or Endamaging the said Cask. Her Maty taking the same into Consideration, was pleased to Order in Councill, That Colonel Seymour Governour of Maryland or the Governour in Chief for the time being do move the Assembly, that instead of the aforesaid two repeated Acts, they pass a new law conformable to that of Virginia, in respect both to the Size of the Hogshead and to the penalty on the offenders therein, and that he Transmitt the same to this Board By the first Conveniency for her Majestys Royall approbation Chr Musgrave
Ordered by his Exncy & this Board that Proclamacon issue to signifye the Repeale of the said Laws which was done accordingly. Then was read the Report of Sr Symon Harcourt her Matys Attorny Genll concerning Her Matys Secry and the Order p. 133 with her Matys Order upon the said His Exncy and this Board resolve to recomend Genll Assembly and by the pressing Arguments & Motives they can use to them en deavour to them to complye with her Matys Royall ple[asure] But inasmuch as Sr Thomas Laurence has suggested that by the Assemb!ys applying the ifynes of those Lycences to the Defraying the pub!iq Charge for four Years He is de feated of £600 sterl, so that He computes them to be annually worth £150 sterl: p Annu.
