    without paying the Duty of one peny p pound he having lost Lib. C. B.

    so much in a Sloope going out of this Province which being

    read & Debated it is Answered that this Board do not thinke

    it within the Verge of their power to Grant the Petitioners

    request there being an Act of Parliament of the Kingdom of

    England whereby the Duty of one peny p pound on Tobacco

    is given to the Use of the Colledge in Virginia which Act is

    so Positive that it is the Opinion of this Boarde the Petitioner

    remains without Remedy here.

      Ordered that the Justices of the lower Countys Inquire what

    Pilots are resident within their Precincts and call thein before

    them to give good Security upon the first alarme to make the

best of their Way to land by Annapolis.         p. 49

   

   

                  Thursday May 23d 1706.

                      Councill Sate

      Resolved the Shipps be all cleared to go to Puttuxent when

    ready to Say]e but that their Severall Clearances be left with

    the Custome house Officers not to be deliverd the Com-

    anders untill they Shall receive his Excellencys Direction so

    to doe.

      His Excellency acquaints the board that Complaint has been

    made to him on behalf of Divers Indians liveing in Charles

    County that a Tomb wherein an Indian Queen is buried has

    been broke open & robbd & divers goods of a Considerable

    value Stolen thence by Englishmen and women living Conti

    guous to the Indian land. He desires to have the opinion of

    the board therein what they thinke most proper to be done for

    the relief of the Complainants.

      Advised & Ordered that Strickt inquiry be made after the

    Offenders & that upon their being taken they be bound over

    to the next Provinciall Court there to be prosecuted according

    to the utmost Severity of the Law.

      His Excellency asking the Advice of the board what Sort

    of acquittance the Coll of the Severall Countys ought to give p. 50

    for the Arms put into their hands out of the publiq Magazine

    by his Excellency for the Countrys Service

      Advised & ordered that from hence forward the Person

    Appointed to keep the Magazine at Annapolis by his Ex

    cellency do take of each Coll upon Delivering out any Arms

    a receipt thereof in Manner following viz.
