376 Assembly Proceedings, April 26- May 3, 1704.

reason itt has not been yett executed, Its judged but reason-
able and therefore requested, that all proceedings in the said
court of Maryland, relateing to the said Lands may be stopt,
and affaires of that Kind rest, untill the Division Line be run
out between the two proprys, which hath of late been the
order, and advice of the president & Councill in Maryland,
and to this wee shall readyly Submitt

Which said case was endorsed by the honble Councill as
followes
With a Lre from Coll John Evans Govr of Pensilvania to
his Excy John Seymour Esquire Governour of Maryland

By his Excy the Govr and Councill
Aprill the 27th 1704

Ordered that mr John Evans Lre with this case be laid before
the house of Delegates, for theire consideration, and for that
this Dispute lyeing soe long undetermined is of very pnicious
consequence, in that justice is impeded, The Sherr of Somrsett
county in this Province and of Sussex not knoweing the Limitts
of theire, Ballywicks, soe that many psons Evade the Laws,
Each of these officers, being fearefull & uncertaine what to doe
upon this occasion, it is proposed to the house of Delegates
to advise the Properest and readyest meanes, to prevent that
inconvenience, and prejudice, that her Maty may be preserued
and her Subjects holding Lands under Proprs may know what
to trust to

I wrote to yor Excy on the first advice I had of yor Arrivall
att Annapolis by a person whoe went home the day before yor
Excy came here, which I hope is come to hand, the good news
of yor Excys arrivall, yor Lady's and family's after soe long
and tedious a Voyage is extreamely welcome to me, the case
herewith sent to yor Excy is fully & duely stated, and I doubt
