The Scheem of wch as agreed by us is as follo
That the Sherriffs shall be obliged to receive all publick
dues either in money or tobo at the Election of the payer pro-
vided such psons tender the money to the Sher. by the first
day of Iany yearely.
But in default of such tender thereof att the time afsd then
it may be Lawfull for the Sher: to execute for the Same as
heretofore he used to doe And further that any Debt due to
him from the publick county or pish shalbe oblidged to take
and receive the Same in money or tobo pporconably to the
money and tobo recd by the Sherriff and the tob: to be vallued
in money by the comissrs in each respective County in Novem-
ber Court yearely and all publick officers fees be alsoe pd at
the eleccon of the debtor in money at the price currant soe
as afsd annually rated every Novr Court as afsd and allsoe all
practitionrs in the Law in any of his Matys Courts of this prov-
ince as afd be oblidged to take and receive their fees in money
at the prices afsd sett or in tob: at the election of the Debtors,
that if publick officers putt not their list of fees into the Sher-
riffs or other hands before the first of January in every yeare
the pty debtor be no ways oblidged to answer the Same that
yeare.

Which being here read and considered the house concurrs
intirely with the said Reporte.
Thomas Tench and Thomas Brooke Esqrs enter the house
and bring the following Message.

By his Excy the Govr and Councill in
Assembly May 13th 1701.

In answer to the houses Message by Majr Dent it is desired
that you will send three or ffower of yor members to Joyne
with two of his Matys honble Councill to conferr thereupon.

Resolved that fower of the members of this house Ioyne
in Conference and ordered that Collo Holland, Collo Small-
wood Collo Loyd and Collo Ennalls attend such of his Matys
honble Councill when and where his Excy shall please to
appointe.
