Iuly the 12th 1698 The Council again Sate present as Yesterday His Excellency being told that Mr Sly had something to communicate to him the said Mr Sly is called in Mr Sly says his Excellency is bound in honour to discharge him for that he has a warrant for what he has done & produced the following Copy of a Record from St Marys Court under the Seal of that Court & signed by the Clerk which is as follows
St Marys County Ianuary the 5th 1696 Order of Governor and Council Dismissing Mr Philip Clark from practising as an Attorney in the Provincial & County Courts Several Minutes taken by Mr Henry Denton Clk of his Majestys honble Council being the Sum of what his Excel lency was pleased to declare to the Provincial Court in relation to Mr Philip Clark being Read in open Court wherein his Excellency declared that if any person had a desire to go for England & Complain against him if so be the Law would permit them to go out of the Province he would permit them and give them fifty Pounds Sterling in order to defray their Charges p. 83 Mr Philip Clark moved the Court that the Clerk might enter his Acceptance of his Excellency the GovTs Offer therein & it is Ordered by the Court that the Clerk record the Same vizt Mr Philip Clark declares that he will go for England & there complain to his Majesty of his Excellency Francis Nicholson Esqr Captain General & Governor in chief of this his Majestys Province &Ca for that he is debarred from Prac tising as an Attorney and thereby hindered from getting his Bread William Aisquith Clk
Whereupon the said Mr Sly is told that he is not now Called to answer for those Articles preferred against his Excellency in England before their Lordships the right Honble the Lords of the Council of Trade & foreign Plantations but to what should be now objected against him on his Majstys Behalf for such misdemeanors as he had lately committed Since his last arrival within this Province & that therefore his offering the said Declaration had no relation & was altogether Impertinent thereto
