            452 Proceedings of the Council of Maryland, 1696/7-98.

           

             Lib. x.  the Clergy &Ca Sly says Collo Good has the papers & Parson

                 Davies did Complain in England about it, is asked if he has

                 any others to prove it, does not Say he has

                  15th He denys to try Collo Cood &ca Sly says Cood has the

                 Papers & that he is not bound to prove any Articles but what

                 Relate to himself for that Coods petition is preferred as well

                 as his

             p. 72    16th Article Denying to take Bayle where the Law Allows

                 it &Ca Sly says it was in the Case of Scurry & Rogers where

                 the Justices would not take Bayle for fear of being sent to

                 Annapolis and Major Smallwood said that some Iustices upon

                 a like Commission had been sent for to Annapolis

                  17th That he threatens the Assembly &ca Sly says Collo

                 Good will prove it & believes he has others, further Says that

                 he has heard it was spoke in the last Assembly

                  18th Article denying to Suffer an appeal in the case Sly

                 Contr Scurry Sly says nothing to that

                  19th Article Driving Collo Cood from Maryland &ca Sly

                 says he has a Copy of the Order

                  20th Article prosecutes Collo Good &Ca Sty says that is

                 Collo Business to prove

                  21st Article taking the Negroes from Sly &ca Sly Says his

                 Brother Robert Sly Petitioned the Govr who sent an Order to

                 the Court & they made an Order there upon, & that as to his

                 Petitions to the Assembly says that if he had been in the

                 Country, his house should not in that time have been made a

                 Prison

                  22d Article, Affronts the Assembly thin'd the house turn'd

                 Cood out & made an Act against Dr Payne, Sly says that is

                 Collo Coods Business to prove.

                  23d Article about Striking People, his Excellency says he

                 did beat Cood when he was drunk & made Disturbance at

                 Divine Service & afterwards came & affronted his Excellency

                 in his own house & that he has from under Coods hand beg

                 ging his Pardon therefore, that he did Cane one Captain

              p. 73   Snowden who in his Excellencys presence being Actually

                 under arms did Suffer his men to fight with drawn Swords &

                 did not endeavour to part & quell them

                  Sly says his Excellency beat one Burroughs whereupon his

                 Excellency replied what if he had the said Burroughs was his

                 Servant & his Cook

                  24th Article about the 400 b due from Coll Cood Sly says

                 that is Coods Business to prove

                  His Excellency is pleased to tell Mr Sly as Before that if he

                 or Cood has any persons to prove those Articles or any other

                 they design to prefer against him if they will not come to

                 Swear to them before the Provincial Court in the face of the
