414 Proceedings of the Council of Maryland, 1696 / 7-98.
Lib. x. when a full house met whether they Ought to proceed upon Business for the Reason aforesd & the Major part of the house was of an opinion that they ought not to proceed but they forbare putting any Such Resolve upon their Iournal but afterwards did resolve that if his Excellency would send forth a writt bearing date before the day appointed for that they would proceed on the matters before them upon which his Excellency was acquainted with the same and desired by the Assembly to send forth such Writt to which his Excellency assented; that as to the Latter Part of the said Article in sending forth Writts for Members when others was Legally Chosen this Deponent refers to the lournal of the Assembly which he Believes will make appear that the said Writts were sent forth by the Order of the house Philip Clarke
8th Article he Suffers Members of the Assembly to be Elected where the Majority of the Electors are known Papists & Disaffected to his Majestys Government Does Say he knows nothing of that Article but does believe Roman Catholicks have elected Burgesses p. 9th Article were Papists and Persons disaffected to the King & Government are Suffered to elect they Choose all such Persons as are disaffected to the King & Governmt as they did lately on Captain Henry Smith of St Marys when another Person was duly elected & returned Said Clark does say he knows Nothing of that Article but is Sensible that the said Captain Smith who was Elected was dissatisfied & dissaffected to the Revolution And being asked whether ever he acquainted his Excllcy or any of the Govern ment or house of Delegates thereof Says he did not 10th Article Such Persons as have been Dissatisfied to the King & Government he puts into the Offices of the Govt To this Article the said Mr Clark made Answer in Writing as follows Vizt As to the Tenth Article vizt Such Persons as have been dissatisfied with his Majestys Government he puts into Offices of the Government This Deponent Saith that as for St Marys County where he dwells according to the Antient Division he knows of no Protestants there what was Refractory in the time of the late Revolution Save one Captain Henry Smith as to other Parts of this Province this Deponent knows nothing of his Own knowledge therefore Refers to the Record & Proceedings of those times which Doubtless will shew who was Dissatisfied who not 11th Such Persons as have been truly Loyal to their Majestys and first appeared for them & Govt he not only Prosecutes & Disturbs but calls them Traitors & Rebells & threatens to hang them
