386 Proceedings of the Council of Maryland, 1696/7-98.
Lib. H. D. ton of Sommersett County, touching his suspention & being debarr'd the practice of an Attorney in tht County Court, by vertue of an Order from his Exncy bearing date the 25th of Octobr last past, as being a great promoter & instigator of a late pretended Marriage betwixt George Layfield Esqr, and one Mrs Priscilla White of that County; This Board having taken into consideration the Petitioners humble Submission in tht behalfe; as also the dutifull Peticon of the Worshipfull the Iustices of the sd County Court (here produced and read) in favour of the said Worthington, are pleased (upon this joyfull and happy news of a peace) to Order thereon as it is hereby Ordered that the said Mr Samll Worthington be restored to his practice of an Attorney and Clerk of Indictments in Somrsett County aforesd in as full and ample manner as formerly; and that the said Order of Suspen sion be set a side; whereof as well the Iustices of the said County Court, as all other persons concern'd are to take due notice and to conform themselves accordingly.

The Council again sate and were present as yesterday. Produced and read the following report Vizt

May it please yor Exncy Iv'e recd and consider'd the Comission to swear the Dele gates and the writt of Prorogation; as to the former I am of opinion tht it is well enough; as to the latter it seemeth to me tht the Causes and reasons set forth in the sd Writt Vizt The Sharpness of the weather & the writts to the Eastern Shore supposed not to be come to the Sherriffs hands and tht a Sufficient number will not meet; need not be inserted in the p. 634 said Writt; but instead of all this, the words for certain causes and considerations us thereunto especially moving, and which is most congruous and agreeing wth the nature of a writt, which is always short and concise in setting forth its' matter, and the former will appear more like a Proclamation than a Writt, the latter I find to be more Presidential, all which is humbly submitted to yor Exncyes consideration by Your Exncyes humble Servant R. Gouldesborough. The said report is approved of and Ordered to be pursued accordingly. Mr Willm Bladens Commission for being Clerk of the House of Delegates was produced, Read & approved off, and signed by his EXnCY and Ordered to pass the Broad Scale of the Province.
