D. the Customs & duties do not appear to you to have been duly paid. 4thly You are to observe and yearly take an account of all goods and Merchandizes, as also of the marks numbers & quantityes of all hogsheads or smaller Casks of Tobacco Carryed by Land or by Water from one of the said Provinces to the other altho the said dutyes have been duly paid together with the name of the person to whom the said goods, Merchandize and tobacco doe truly and Bona fide belong and in case any of the said Goods or Merchandizes were imported into either of the said Provinces you are to inform your self upon what Ship and Masters name and from what place they were imported, as also of the name of the Master and the Ship upon which any such tobacco shall be Loaden & putt on board and to what place bound and the same to enter fairly in a Booke kept by you for that purpose. 5thly And where you shall find just cause to make seizure of any Shipp Vessell goods or Merchandize for breach of any of the aforesaid Acts, you are forthwith to give notice thereof to p. 166 any of the members of his Majesties Council of this Province or to one of his Majesties Iustices of the Peace if near inhab iting where such seizure is made or otherwise to the next Civill or Military officer who are to be aiding & assisting to you, to be safely convoyed to some convenient house where they are to be safely kept without imbeziement and there to remaine till discharged by law giving Notice to the Attorney Genrll or to such other person as already is or shall be appointed for a speedy prosecution therof. 6thly You are not in your own name or in the name or names of any other Person or Persons or in Company or Part nership with any other trade as a Merchant for your selfe or as a Factor or agent for any other in or for any Goods or Merchandizes except for necessary Provisions of your family, you are not to absent your selfe from your duty without the leave or approbation of the Surveyor Genrll for the time being nor remove out of your proper Station for your own private advantage and conveniency or otherwise behave your self upon pain of being suspended from your office.
