other then to his Majtes naturall born subjects of England Ire- Lib. H. D. land or Wales or Berwick wthout the lycence and consent of his MajtY his heires & Successrs signified by his or their order in Council first had & obtained. You shall give notice thereof to His Majty or to the Lord high Treasurer of Eng land or Comrs of the Treasury in England for the time being. Fourteenthly. You shall take care that all places of trust in the Courts of law or what relates to the Treasury of the Province of Maryland be in the hands of the native born Sub jects of England or Ireland or the Plantations. Fifteenthly. And that there may be no interruption or delay in matters of prossecution & Execution of Justice in the Courts of Judicature within the Province of Maryland by the death or removal of any of the Officers imployed therein untill his MajtY can be advised thereof and appoint others to succeed in their places you shall make choice of persons of known loyalty Experience diligence and fidelity to be employed for the purposes aforesaid, untill you shall have his Majesties approbation of them or the nomination of others from hence. Sixteenthly. You shall from time to time correspond with the Comissrs of the Customs in England for the time being & advise them of all failures neglects & frauds or misdemean ours of any of the Officers of the Customs in the said Prov ince of Maryland & shall also advise them as occasion shall offer of all Occurrences necessary for their Information re lating either to the aforesaid Laws of trade & Navigation & the Revenue of Customs and other duties under their man agement both in England and the Plantations. Seaventeenthly. Whereas by the aforesaid Act for prevent ing frauds & regulating abuses in the Plantation Trade ‘Tis provided for the more Effectuall prevention of ifrauds wch may be used to elude the intention of the said Act by Coulouring of forreign Ships under English names that from & after the 25th March 1698. No Ship or vessell shall be deemed or pass as a Ship of the built of England, Ireland Wales, Berwick, Guernsey, Jersey, or any of the Plantations in America so as to be quali fied to trade to from or in any of his Majesties said Plantations p. 159 untill the Person or psons clayming property in such Ship or Vessell shall Register the same in manner thereby directed. You shall take care that no forreign built Ship be permitted to pass as a Ship belonging to the Kingdotii uf England Irc land, Wales or Town of Berwick upon Tweed until proofe be made upon Oath of one or more of the Owners before the Collector & Comptroller of the Customs in such Port to wch she belongs, or upon like proof before your self wth the princi pall Officer of the revenue resideing in the Province of Maryland If such Ship shall belong to the said Province of Maryland
