To his Exncy Sr Edmd Andros Knight Capt Generall and Governr in Chief of his Mats Colony of Virginia. The Humble Pet. of Philip Clarke of St Maries County in his mats Province of Maryland most humbly Sheweth to yor Exncy
Mr Clarks Pet. That whereas yor Peticonr in the late Revolution to Sr Edmund Andros &ca was admitted & Sworne an Attorney in the
Prov” Court and in Severall of the County Courts of the sd Province and in the Same did Practice till the tenth day of August last at which time yor Petioner Recieved a Sumons to appear and serve his Mats as a Justice of the Provll Court, upon wch Sumons yor Petitionr did most humbly Petition his Exncy the prsent Governr that forasmuch as he had been alway's ready to Serve his most Sacred Maty in the late revolution and since, & tht the Practice of an Attorney was that upon wch the whole maintenance of his ifamily did depend did therefore most humbly pray that he might not be dis charged from his sd Office of an Attorney by being made one of the sd Justices neither of wch Reasons did prevail with his Exncy Soe tht yor Petitionr in Obedience to the sd Coiiiission did accept of the same hopeing by this Submission to Con tinue his Practice in the Severall other Courts of the Province but his Exncy having in December Court last Conceiv'd a prejudice agt yor Petionr for what yor Petionr knows not, Except for Refusing as Judge of the sd Court to grant a Judgmt agt Coll John Cood Contrary to Law, did for four days together Come down to the prov” Court and Sit there in his proper prson where he did Endeavour to prove yor Petionr Guilty of Some Crime that might deserve Imprisonmt but the p. 81 Evidence after all his threats not Swearing as he desired was
