[Council to Delegates in Congress.]

In Council Annapolis 26th May 1779
Gent
By the Resolution of Congress 16th Septr 1776, the Appoint-
ment of all officers and filling up Vacancies (except General
Officers) was left to the Governments of the several States.
3ist Decemr 1777, the Congress recommended to the Govern-
ments of the several States to suspend filling up any Vacancies
in their respective Regiments until they should hear farther
from Congress on the Subject. We have not yet heard farther
from Congress on the Subject though doubtless many Vacan-
cies in the State Regiments have been filled up since the
31st December 1777. The Officers in the Maryland Line
complain of a Want of Subaltern Officers and probably there
may have been some Appointments in that Line without
consulting us. Filling up Vacancies is a Work not the most
agreeable to us, but we cannot, with Propriety give up that
Part of the Civil Power of this State. You'll oblige us by
letting us know whether there's any Resolution contrary to
that of Decemr 1777, or whether it remains for Want of
attending to it. In the few Instances that may occur where
young Gentlemen of Merit are recommended to us before we
hear from you, we shall request the Board of War to com-
mission them as we are satisfied such are wanted

Commissions issued to Benjamin Tevis appointed Capt in
the room of Thomas Philips John Chapman 1 Lieut, Joshua
Chapman 2d Lieut, Robert Tevis Ens. Elie Dorsey Capt in the
room of Richard Owings, James Barnes 1 Lieut, Johnny Sell-
man 2d Lieut Tobias Talbot Ens. Joshua Hurd Capt, in the
room of Thomas Owings, Thomas Wire 1 Lieut, Thomas
Greenwood 2d Lieut, William Parker Ens. Joshua Hartestiom
Ens. of Captain Wm Hudson's Co and Thomas Chenoworth
Ens. of Capt. Mordecai Gosnell's Co belonging to the Soldiers
Delight Batt. of Militia in Baltimore County
Ordered that the western shore Treasurer pay to Benjamin
Wailes, thirty three Pounds, eighteen shillings and nine pence
and the further Sum of One hundred and thirty eight Pounds,
eleven shillings and eleven Pence half penny for the use of
James Bennett due him per Accts passed by the Depy Aud.
That the said Treasurer pay to Benjamin Wailes Eight
