his Commissions are both for the Seventh District; if so there's
a Mistake in yours; it should have been for the sixth as you'll
see by the inclosed Copy of a Resolution of the Assembly.
We send you a proper Commission to rectify the Mistake if it
has really happened, which will give you the Trouble of another
Qualification, which we are sorry for.
We are &ca
Adam Muir Esqr
[Council to J. Banning.]
In Council Annapolis 25th Febry 1779
Sir.
We do not know of any Method of punishing the Parties
concerned in sending out Flour in the Lady Washington but
on a Prosecution agreeable to the late Act Chap. 3d of the last
Session and we much wish that the Matter may be enquired into
in due Course; the Vessel had no Letter of Marque from
hence as we can find. The Nature and Powers of your Office
are in a very loose Way; we do not apprehend that the old
Regulations, chiefly made by Acts of Parliament, now subsist ;
it is absolutely necessary that the Duty and Power of Naval
Officer should be precisely and clearly pointed out by an Act of
Assembly and we hope and expect it will soon be done. In-
closed you have the Resolution of the Assembly, which erected
and describes the Districts; your Commission is right and we
have returned it; the Minute we have of Mr Muir's is of the 6th
and right also but, as it may have been filled up wrong, we
shall send him another.

Jeremiah Banning Esqr
