rate Person to deliver out and receive in the Arms &ca and
keep an exact Acct of his Transactions. We are &c.

In Council Annapolis 21st May 1778
Sir
We inclose you two Letters received from Colo Barnes
respecting the Conduct of Lieut Menger. We have not gone
into an Examination of the Facts alledged by Colo Barnes, as
we should not, on the Proof of them have undertaken to
dismiss him from the Service, but Capt Fenwick, who is
referred to, in his State, confirmed what is said in the Letters.
We are much inclined to forward the Business of the Officers
and treat them as Gentlemen but are fully in Colo Barnes's
Sentiment, that Mr Menger's Conduct deserves Reprehension

In Council Annapolis 21st May 1778.
Sir.
James Robinson, who was by you adjudged a Vagrant,
under the late Act, has put in a Remonstrance and Complaint
against your Adjudication. From the Papers laid before us,
we should have been inclined to set Robinson at Liberty, but
for the Suggestion, in your Certificate, that it was offered to
be proved on Oath that the Indenture to Mr Keene was
entered into to screen Robinson. You properly judged that
the Matter turned on that Fact and, if there's any Proof of it,
we are desirous of having a Deposition made of it and trans-
mitted to us. In the mean Time we desire that Robinson may
not be sent away, but have an Opportunity of examining the
Witnessor Witnesses who may be sworn to prove the Indentures
being entered into for the Purpose before mentioned and on
his giving Security to appear here, that he may be at Liberty
to prosecute his Appeal. We are &ca
