  The honoble Coll Charles Hutchins

           Coll David Brown

  Lrs from Coll Produced at the Board a Letter by his Exncy Recd

  Addison

  together from the honoble Coll John Addison, together with a

  with Depo- couple of Depositions inclosed in Relation to the

  sitions touch- d

  ing the afores Murther which were Read; Ordered that the Ordr inde

  Murther &ca sd Depositions & papers be delivered to Mr Attor

 

  ney & Sollicitot Genll for them to make Report therein as to

  matter of Law, as also to the Justices of the provinciall Court Whitehall

  for their pervsall & Report likewise, which were accordingly

  delivered to Mr Attorney Genll at the Board together with a

  Copy of the Articles of peace &ca

 

       The same came Reported as follows, Vizt

 

             To his Exncy the Governr &Ca

  May it please yor Excell

 

  Attorney We have consulted these papers relating to the

  & Sollicitor suspected Indian, and as to their weight & efficacy

  Genlls Re- .        .    .

  port vpon in Law, We conceive that it is not sufficient Evidence

  the above in Law to Convict the Indian, though perhaps of

  Ordr weight enough as We conceive with a Grand Jury

 

  to find a Bill, but that cannot be done this Court, the Jury be- Whitehall

  ing discharged; therefore We conceive he ought to be secured

  till the Assembly, and in the mean time that Warrant should

  issue for the securing the other Indian sworn against by par

  ker & Montray; All which is humbly submitted to your Excell by

                        Yor obedient Servants

    The Justices of the Provinciall Court do Concurr with the p. 340

                                              Whitehall

  above Result, and that Care may be taken for the Apprehend

  ing and securing of the Annacostin King, who formerly was

  Comitted into Custody vpon suspicion of being guilty of a

  Crime of the like Nature.

    The sd Report was Approved off, and Warrant was accord

  ingly issued & sent vnto the honoble Coll John Addison, to
