410 Proceedings of the Council of Maryland, 1694 97.
Lib. H. D. & about the prmises, and their sentence therein given (re maining among the Records of our high Court of Chancery) to be thither transmitted vnder the hand & Seal of the Regis ter of the sd Court and there laid before you, that the Com plainant may make such Exceptions against the same as he shall thinke fit & convenient, and the severall pleadings Testi monies proofs & Allegations on both sides, being strictly heard & Examined, and the Matter duely Maturely & deliberately weighed and considered, you are to pass & give your finall J udgmt sentence doome & decree therein, according to Justice & the Civill Law & other the Laws of this province, and to the best of your skill & vnderstanding, as also to taxe all Costs & p. 328 Charges thereon Accruing, hereby Empowering you to Ad journ your sd Court from day to day or from time to time, untill the sd Matter by you the said Commissionrs shall be fully determined and to the End a true & fair Record may be kept of your proceedings herein; We have thought fit to Nominate & appoint, and We do hereby Nominate & Appoint Henry Denton Gentleman to be your Clerk or Register, to Receive take & Enter on his Journall the sume & substance of what shall be done and Acted by you in the Execution of the power and Authority hereby given & granted you,a fair Copy where of attested vnder the hand & Seal of your said Clerk you are to transmit vnto Us in our high Court of Chancery, with all convenient speed; Given vnder the Great Seal of our said prov ince, the Sixth day of May, in the Eigth year of our Reign &ca Annoq Domini 1696. Witness our trusty & well beloved ffrancis Nicholson Esq. Capt Gen” & Governr in Chief in & over our sd Province & Territory of Maryland. ffr: Nicholson.
On the back of the sd Commission was thus written, Vizt William the third by the Grace of God, of England, Scotland ffrance & Ireland King defender of the ffaith &Ca To Coll Wm Pierce & Mr Edward Boothby Gentlemen, Greeting These are to Authorize you or either of you to Administer vnto Coll George Robotham & Coll Nicholas Greenberry or either of them the Oaths appointed by Act of Parliamt to be taken instead of the Oaths of Allegiance & Supremacy, as also an Oath of Commissionr for this purpose to be framed and the sd Oaths being as aforesd Administred & taken you the Sd Coll George Robotham & Coll Nicho Greenberry or either of you are to Administer the aforementioned Oaths to the rest of the Commissionrs withinnamed, and to the Clerk, for which this shall be your sufficient Warrant, Given vnder the Great Seal of our sd Province this Sixth day of May in the Eigth year of our Reign &ca Annoq Domini 1696.
