this board that the same is all irregular there noc thing appeare- Lib. C. B. ing to this Board in the said W Randolphs Comission Empowering him to place or displace Officers in any of their p. 44 Majties Governmts in these parts, but that the same wholy Iyes in the breast of such Governments. Ordered therevpon as it is hereby Ordered that the said Philip Clarke henceforth desist from further acting by Vertue of such Comission, and that linediately vpon Notice given he deliver vp all Papers remaining now in his custody relateing to the said Office of Collector Unto the aforesd George Plater, whoe is hereby fully Empowered to continue to Act as Col lector of that District according to the Tenor of his Comission Granted him by the Governmt Untill further Order.
James Bigger's Mr James Biggers humbly Moveing this Board on behalfe of Mr Thomas Green feild who had lately behalfe Granted to him by the Comissary Generall of this Greenfeild p Appeale, Province Letters colligendum vpon the Estate of Granted &ca Richard Charlet deceased, whoe by Vertue thereof
had made some progress & been at some Expense in the Col lecting part thereof according to the direction of the Law in that case, but by some meanes or other Letters of Administra tion have since been Granted to two other persons noe wayes Creditors, & therefore much to the prejudice, as is conceived, of the persons interested in the same, therefore the said Mr Bigger does in right of the said Mr Green feild humbly pray an Appeale from the sentence of the said Judge, in Order that the same may be duely Examined according to Law—And for p. 45. the due prosecution of the said Appeale the said Mr Bigger on behalfe of the said Thomas Greenfeild does here tender to this Board Mr William Parker & Mr Hugh Ellis together with himseife his security and at the same time came as well the said James Bigger whoe acknowledged himselfe to become bound in the sume of Two hundred Pounds & the aforesd William Parker & Hugh Ellis in the sume of One hundred pounds sterling each Vizt that if the said Thomas Greenfeild shall not prosecute his Appeale with Effect that he therevpon pay all Costs and Damages that may happen to Accrue to any person concerned, in case that the Sentence of the said Judge shall be affirmed, by reason of such his Appeale, whoe sever ailly consented therevnto Ordered therevpon as it is hereby Ordered that an imediate stop be put vpon the proceedings of the aforesd Administra tion, and that the Administratoes vpon due Notice hereof given them yeild all due obedience herevnto, Untill there be a full decision & determination in the premisses.
