             Mr Withers Vpon the Return made by Mr Samuell Withers

             touching the late Sherriff of Talbot County of a certain Ordinance

             6000 l of of Assembly directing him to reseive & keepe in his

             withstanding which they Ordered Mr Goldesborough Attorney

             at Law to bring their Action against him, who did according

             ly and got Judgment. Vpon a Return also of the said Withers

             made vpon an Ordr of the 21th of November last from his

             EXDCY sent, thereby commanding him to still keepe in his hands

             six thousand pounds of Tobacco by him Leavyed within the

             parish of St Michaells, notwithstanding an Ordr of the House

             of Burgesses to the contrary the said Order never having

             passed his Exncy nor Councills Assent whereby to suspend or

             take off the former Ordinance; to which the said Withers did

             Return that the said Tobacco he had still in his hands and

             shew'd the said Order as well to the Commissioners of Talbot

             County in Court sitting as to the Vestrymen of St Michaells

             parish, who tooke no Notice thereof, but insisted vpon execu

             ting him for the same; therefore prayed that a stop might be

             put thereto and some further Ordr given what to do with the

             Tobacco; Ordered therevpon as it is hereby Ordered that the

             said matter be Referred to Mr Attorney & Sollicitor Ge&' for

             them to direct & advize which way the sd Execution may be

             stopt, and that they take care fortwith to prosecute as well the
