      Lib. H. D.     stead; And therevpon Ordered that the honoble Coll David

            Brown be inserted therein accordingly; which accordingly was

            done and prepared a new & was signed by his Exncy & passed

            the Broad Seal of the Province, the Tenor whereof runs as fol

            lows, Vizt

     

            Maryland ss:

     

            Court of William the third by the grace of God King of

             England, Scotland, ifrance & Ireland Defender of

                   the ifaith &Ca To Coll David Brown, Coll John Addi

            son, Coll John Courts' Thomas Brook Esqr Majr John Hamond,

            Capt Richard Hill & Capt Thomas Tasker Greeting Whereas

            complaint hath to Us been made by James Crawford of Cal.

            vert County Gentl. that he is Agrieved with a sentence of the

            Commissary Ge&' of our said province in a difference before

            him depending between the sd James Crawford former Admr

            of John Abington deceased & George Lingan of the aforesd

            County the present Administrator of the said Abington, con

            ceiving great wrong & injustice done him by the sentence

            aforesd did therefore Enter his Appeal from the sd sentence in

            due form of Law, as to us hath been set forth & made appear,

            praying our speciall Commission might issue to constitute

            such and so many persons, as We should think fit (in the

            nature of a Court of Delegates) to Examin the said sentence

            &Ca And We being willing that speedy Justice should be done

            therein & a suitable relief granted pursuant to the directions

            of the Law in that case, have therefore assigned, constituted,

            Ordained & appointed And by these presents We do consti

            tute Ordain & appoint you the said Coll David Brown, Coll

            John Addison, Coll John Courts, Thomas Brook Esqr Majr

            John Hamond, Capt Richard Hill & Capt Thomas Tasker or

            any five or more of you (whereof you the sd Coll David Brown

            or Coll John Addison to be always one) our Commissionrs

            especially to inquire to, Examin, heare & determin the prem

            ises, And to that end you are to meet in some convenient

            house at our port of Annapolis, on the twelfth day of this

            instant October by two of the Clock in the afternoon, and

            there to call & cause to come before you as well the said

         p. 226 Complainant James Crawford as also George Lingan afore

            named and all other persons therein any wayes concerned,

            And you are further likewise hereby Empowered as a!so

            Required to command a full Transcript of all the Proceedings

            had & taken in our Commissary Genlls Office in and about the

            premises, and his Sentence thereon given to be thither trans

            mitted vnder the hand & Sea! of our said Commissary and

            there laid before you that the Complainant may make such
