Randolph Esqr Deputy Auditor & George Plater Esqr their Lib. H. D. Mats Receiver and Attorney Generall take care to put in pro cess agt the said Cood, on behalfe of their Majts such part of the said sume as he shall not justly discharge. Governrs His Excellency demands of Thomas Tench Esqr demand how he would Administratr of the said Governor Copley how he PaY the Debt would discharge & pay the said Money who makes due to their Answer that he has paid out the said Estate already Mats from so farr as he has Assets, and for further satisfaction Governr Copleys of his Exncy & the Board he Offered the following Whitehall papers, Vizt Maryland ss:
At the City of St Maries, Novembr the 16th 1694
The Deposition of Thomas Tench aged vpward of thirty year, vpon Oath saith.
Thomas That this Deponent coming to this City sometime Whitehall in September, A° 1693 after the Decease of his p. 96 tion Exncy Lionell Copley Esqr Governor of this Province being at the house of the deceased, Coll Nehemiah Blackiston and Mr John LLewellin shewed this Deponent an instrument of Writing which Mr LLewellin informed this Deponent was according to the deceased's Order, And he intended to signe and declare it to be his last Will & Testamt but it pleased God to take him to himself before he could accomplish the same in which Writing this Depone found nominated (as Trustees to take care and Manage the said Governors Estate after his Decease) Coll Nehemiah Blackiston, Coll Nicholas Greenberry. George Plater Esqr Mr John LLewellin and this Depont Coll Blackiston being then Commissary Genll could not take vpon him the Administration, Mr LLewellin excused himself likewise having so much pubiick business to do, they perswaded George Plater Esqr and this Depont (being nominated by his Exncy) to take out Letters of Admrcon on the deceased's Estate, accordingly they did, but before they proceeded to Appraisemt Sr Edmond Andros Arrived in this Province, and after he was admitted to Act as Captain Generall (as this Depone was informed) His Exncy inquired how Governor Copley had dis- Whitehall posed of his Estate, vpon which the eldest Son and heir of the deceased shewed his Exncy his ffathers intended Will, vpon pervsall of which his Exncy advised the said eldest Son & heir of the deceased or acquainted him it was his Right and in his possession to choose whom he pleased to administer on his ffathers Estate in his & the other Childrens behaife, as the said
