Attorneys con- Whereas the Provinciall Court of this Province sRlted about . the New was by Proclamation Adjourned vntill the Sixth day Provll Com- of November instant, And forasmuch as a New ission what . to be done, Commission for holding the said Court by Order of for want of his Exncy and this Board hath been issued wherein
the President to whom and whereby Robert Smith of Talbot County Esqr dedimus is Speaker of the House of Burgesses is appointed directed and constituted Chief Judge of the said Court and
therein especially Authorized to be sworn by Robert Mason & John Watson Esqr to wch three persons the Dedimus potes tatem was Especially directed, but the said Mr Smith, through stress of Weather as is reasonably supposed not being able to pass over the Bay, And sufficient Number of their Majties Honoble Councill likewise not coming whereby the said Court might be Enabled to sit by Vertue of the old Commission; therefore taken into consideration what proper Methods to make Use off in such an Exigent of Affairs; Wherevpon was sent for what Attorneys were in Town to Advize about the premises, And Accordingly appeared Mr Attorney Generall, Mr Cheseldyn Mr Dent. Mr Clarke and Mr Watkins, And the Matter being stated to them by his Exncy They do Answer that the Court may be further Adjourned by the old Commis sion vntill to Morrow Morning, And therevpon Ordered that
