Lib. H. D. from Sr Edmond Andros by W Sherlock Clerk of the Coun cill of Virginia, intimating that Sr Edmond was speedily com ing over with a Commission to Enter vpon this Governmt vpon the death of Governour Copley they deferred the said Con ference And vpon his Arrivall which was the 25th following he produceing their Mats Commission they willingly and readily submitted to the same Thomas Laurence Nich: Greenberry David Browne John Addison Present to the 22d of September and John Courts Agreed to the sd Conference Tho: Brooke
That as to the second part of his Exncies Demands, severall Justices & Commissionrs of the Provinciall Court living at some distance from the City of St Maries were on their Voyage & Journey in Order to be at the said Court the first day of the session thereof but by Extremity and stress of Weather, there did not come a sufficient Number of Justices to Enter vpon Business yet enough to Adjourn the Court according to the Law of the Countrey; the next day there appearing a full Bench.

Governors His Excellency Representing to the Board that one Representa- . tion about Doctor Payne in England had set forth and signified Doctor to him how that he the said Doctor Payne had Payne been a person very instrumentall in Solliciting and Carryeing on the Affairs of this Province in the time of the late Revolution and to the said End & purpose kept a frequent 45 correspondence with the Chief Men then in Government His Exncy was desirous to know if there were any Gentlemen here present that had been privy to such Matters, to which they severally Replyed, they were ignorant of any such thing, but supposed that Mr Cheseldyn & Capt Cood could give his Exncy the best satisfaction therein and therevpon Ordered that the said Mr Cheseldyn & Capt Cood be sent for to Attend this Board on Munday next to know what they can say in the premises.
