Lib. H. D. to their Mats Receiver Generall, Yor Petitioner therefore com plains that there is no svch person Appears to Receive & take Charge of their Mats part; Also that your Petr hath & is at great Charge in the hiring Men, Boats, Stores &ca to his great Charge & Damage; Also your Petr hath appointed the 30th of this Month for publick Sale of the Goods coming to his part and has given Notice accordingly which Sale cannot be proceeded to before the Goods be divided, Also your Petitionr is to his great loss & damage hindred hereby of Loading his owne ship with Tobo and if these Goods be not speediiy divided will loose the oportunity of the Convoy Yor Petr therefore prays yor Exncy and Honors to take these Reasons into your serious consideration and Order some person to Receive from the Commissionrs their Maties part of the said Goods forthwith that the rest may by the day appointed be Exposed to Sale and your Petitioner proceed in his other Affairs And as in Duty bound he shall pray &ca
Admiralty Afterwards presented to his Excellency Copy of cedings in the Proceedings of the Court of Admiralty beld at the Tryali Benedict Leonard Towne in Calvert County the 13th of the Prize . ship pro- of this instant July; Wherevpon his Exncy did Demand Whitehall duced to know by what power the said Court was held, to which was Answered that the same was held by Virtue of Governor Copleys Comission of Vice-Admirall, the which should be produced to his Exncy to Morrow.
Ordered that Copy of the late Governor Copleys Coinission of Vice-Admirall be delivered to Mr Attorney Gen” to put into English such Clauses & Exceptions as may make Governrs Comissionfor or against the Erecting such a Court and there of Vice-with Attend this Board accordingly; as likewise that
Admirall Ordered to the present Governors Comission be by him wholy be translated translated into English, in Order to be put vpon into English Record for satisfaction and pervsall of all persons. Whitehall July 28th 1694.
