2 Clock, on ffriday night following the murder was Com-
mitted, and the body kept privately on board till Saturday
night before the very Servants of M^r Rousbys house had any
knowledge thereof untill it was brought a shoare. That by
vertue of his Commission the Command^r of the Ketch tooke
upon him to command one Capt. Doebury Command^r of a
M^rchant mann then in the said River together with the said
Allens Brother to goe on shoare to s^d Rousbys house and
secure his goods under lock and key and to bring the keys
aboard to him

Coll Talbott to be demanded of the Governm^t of Virginia &c

The proceedings of the said Coll Henry Darnall and Majo^r
Nicholas Sewall in this affaire being approoved on by the board
It was Resolved that, if the said Cap^t Allen should Offer to
carry away the said Coll Talbott a prisoner into Virginia (as
he had given out) demand should be made by this Governmt
of that Governm^t for the delivery up of the said Prisoner to
be tryed here where the fact was committed, and that a Lett
for that purpose be writt to the Lord Effingham, desireing
him also together with the prisoner to send over such persons
belonging to the said Ketch as cann give any Evidence
against the prisoner upon his tryall

M^r Vansweeringen Compl' ag^t Cap^t Allens men.

Came M^r Garratt Vansweeringen of the City of S^t Maries
and complained of severall insolencies and injuries done him
by Cap^t Allens men when they came a shoare there in Octo-
ber last to w^ch he made oath in manner foll (viz.)

The Deposition of Garrat Vansweringen gentl one of the
Aldermen of the City of S^t Maries
About the 20^th day of October soe neare as I cann guess, I
came from my plantation being on horse back, I mett with a
party of Seamen within the City of S^t Maries goeing toward
M^r Lynes, I asked them from whence they came, they
answered me very roughly from home, whereupon I askd
them some other questions what they were but could gett noe
other answer of them then as is said before.
But meeteing with two or three of the said Crue with mus-
ketts upon their shoulders, and those'men heareing me ques-
tion them that went before, they told me we belong to the

Mann of Warr, I ask'd them againe who is your Cap^t? and
they replyed Cap^t Allen, and soe I went my way, and parted
from them.
