done there, but his said Attorney appealeing to the Generall
Court without his ordrs (though Capt Brent said he produced
a Letter which satisfied the Court) and bringing him in more
charges by two thousand pounds of Tobacco, he thought it but
reasonable to refuse the payment thereof, and therefore he
brought those men (as some say) to secure himself, and as
others more favourably report to accommodate the business
with Mathena, I should not have sent your Honors this bare
report (by which, as uncertaine, noe determinate Judgemt cann
be given) knowing it to be my duty to have taken the deposi-
tions of some witnesses to all transactions in this business; as
Michael Ashford, William Sanders, John Richards &ca but I
hope my extreame illness will plead my excuse in that point,
haveing had a relapse.
That your Honors may be favourable to Virginians in your
Judgemts of this concerne, Coll Spencer shews how much he
intends to stand up for the Interest of Maryland,
ffor a Marylander sued one MrManley (formerly of the same

Province) in Virginia, and it was pleaded in barr that he
brought noe Effects out of Maryland, whereupon It was ad-
judged by the Court to be Law, now the Secry: is of opinion
that if the plt appeales to the generall Court it will be ad-
judged otherwise
This I had from Capt Brent, who together with his Honor
thought it convenient to be communicated to the Governor
and to desire them to beleive that they did not doe it to be
over busie or to create any trouble or difference, but in ordr to
a due Correspondency betweene the two Governmts
What ever your Honrs result may be, if yee think conve-
nient to let it pass through my hands, I will give it as safe
and Speedy a passage as I cann; if not I beg a word, because
I am to give an answer to his Letter; I wish I were with your
Honors that I might improve my self in ordr to serve my Lord
in Court; but the Pyes wings are dipt, which I hope your
Honrs have the nobleness to pitty, rather then to condemne me
of any neglect
