the same betweene them by the directions of a Jury of the
Vicinity or otherwise, You may in such cases, and have hereby
power given you upon such request made grant such warrant
as is desired
11: Where it shall be discovered or made knowne unto
you that any Grant or Pattent hath' heretofore been illegally or
Surreptitiously obteined; or if any Pattent shall at any time
hereafter be soe obteined, you may and are hereby required
to ordr Scire facias to issue forth of our Chancery Court of
Records, to the Pattentee, or other prsent Owner and Possessor
thereof, to shew cause why the same should not be vacated:
And if the said Land shall be adjudged and condemned unto
us for the reasons aforesaid, you may by Letters Pattents or
otherwise give grant or dispose of the same, to the discoverer
thereof, or other person or persons Suitor or Suitors to you for
the same, upon such conditions and tearmes as to you shall
seeme meete.
12: Vpon the death or remooveall of the SurveyrGeneralI
(to whom or his Depties all speciall warrants have been and
are to be directed) want of convenient tyme, or other Speciall
occasion happening and evidently appeareing, you may cause
and give ordr for the renewing or continueing of any speciall
warrant, warrant of Resurvey or other ordr of Councill as the
Case shall require
13: Any Person or Persons takeing up upon conditions of
Plantation pformed, or upon Speciall or Conditionall warrant
from us or our Councill duely obteined any Tract or Quantity
of Land, falling within a former Survey or Reserve for us
made, may upon supplication have warrant granted him or
them to make good the like Quantity upon other waste Land
in any part of the Province
14: Conditions of plantation performed, and by the care-
lessness negligence or ignorance of the Clark of the Office
omitted to be duely entred upon Record, may (upon due
proofe made, and other undeniable Testimony to you appeare-
ing) be ratifyed, confirmed, approoved, and made good by yor
ordr to the benefitt of the party concerned.
15: Noe Advantage shall be taken by lapse of time in sue-
ing forth Pattents for Land taken up upon conditions of plan-
tation in all respects otherwise pformed; where it shall appeare
that the same has happened by default of the Clerk of the

Office, negligence of the Surveyor or ignorance of the party
