now soe it is may it please your L^dspp that the said ffrancklyn

did in his life tyme leavy some part of those Rents and leavys
& other publick duties, and the same did duely pay away and
likewise he the said Sheriff did out of his owne Estate pay
and discharge severall greate summes of Tobacco to severall
persons interested in the same, and before he could reimburse
himself out of the publick duties to be by him leavyed, or
make up his Acco^ts with severall persons Debt^rs to him on the
publick Acco^t he the said ffrancklyn dyed very much indebted
to yo^r Pet^r who as principall Credito^r hath taken Adm^rcon of
the Estate of the s^d ffrancklin And because your Pet^r without
your L^dspps gracious favour cannot recover such of the publick
dues as were due to the said Robert ffrancklyn from severall
persons who remaine Debt^ts to the said deed: for their leavys
rents and other publick Tobaccos without power to leavy the
same by way of Execution upon the Estates of the said Debto^rs
And for that your Pet^r as Admn^rs cannot have execution upon
them without some speciall ord^r therein first had & obteined
from y^r L^dsp and being unwilling to surprise any, but that they
may have day to plead any legall discharge
Y^r Pet^r humbly prayes your L^dsp to grant him your L^dsps
writt of Sciri facias issueing out of either your L^dspps Provinciall
or County Court against all such persons Debt" as aforesaid
to shew cause if they have any why execution should not
issue against them for all such publick Debts as aforesaid
And y^r Pet^r as in Duty bound shall ever pray &c^a w^ch peti-
tion was granted & endorsed as foll (viz)

Ordered that the Com" of the County Court of Anne
Arrund^ll in Court sitting Command their Clerk to issue out
sciri facias as is prayed.
