themselves and familyes, nor committ any other wast or
Spoile as breakeing downe or burning of ffences &c tending
to the prejudice and greivance of the said Inhabitants and to
the penalty of being censured to Suffer as the Generall Court
Marshall shall thinke fitt.
When the Army or any part thereof shall come to
170 engage the Enemy in fight, whoever shall runn from his
Colours (be he native or Stranger) or doth not defend them
to the utmost of his power so long as they are in danger shall
Suffer death for it, And whatsoever Souldier shall at any other
time runn away from his Colours shall Suffer death or such
other punishment as a Generall Court Marshall shall thinke fitt.
If any Regiment or Comanded party shall not behave
themselves in fight against an Enemy as they Ought to
doe they shall answer for it before a Generall Court Martiall
and the Officer or Souldier who shall be found faulty therein
shall suffer such punishment as shall be thought fitt to be
inflicted on him by the Generall Court Marshall aforesaid.
When it shall please God that Our fforces shall beate
190 the Enemy every man shall follow his Officer in the chase
but whoever shall presume to pillage or plunder till the
Enemy be beaten, and any misfortune happen he shall Suffer
death or such other punishment as shall be pronounced
against him by the Generall Court Martiall and the pillage so
gotten shall be forfeited to the use of the sick and maimed
Soldiers.
No Officer or Soldier whatsoever to plunder or pillage
any house or plantation of or belonging to any the
Inhabitants of this Province (without leave or necessary
reason) much lesse to sett fire or lay wast any such house or
plantation as aforesaid more especially any house erected for
divine worshipp & Service whether called by the name of
Church Chappell or otherwise neither shall they Offer Vio-
lence to any the good people of the Province whether men or
women maids or Children more especially such as Officiate in
either Church Chappell or elsewhere in the divine worshipp
and Service of God whether preists ministers or Others
unlesse such men women or Children and others as before-
said be found actually in armes against them upon paine of
death or other punishment at the discretion of the Generall
Court Martiall, but whoever shall force a woman to abuse her
and the fact be Sufficiently proved against him he shall cer-
tainly suffer death for it.
No Soldier shall presume to make any Alarme in the
Quarter by Shooting off his muskett in the night after
Lib. R. R.
the watch is sett unlesse it be at an Enemy upon paine of Suf-
fering such punishment as a Court Martiall shall thinke fitt.
