Wharton had lived longer he the said ffendall should have
risen agt him, but that now the fforegoeing Discourse (being
delivered by him the said ffendall in like manner before Mr
Rozer at Mr Notleys house) had scared him the sd Wharton
out of his life.

Warrant then issued from undr the hand of the Honble Wm
Calvert Esqr requireing Capt Josias ffendall to make his
appeareance here this Day in the words foll. viz.

Maryland ss :
Whereas Information hath been made that Capt Josias
ffendall of Charles County within this Province hath uttered
Divers false malitious and scandalous reports touching his
Lspp: the Rtt Honblec the Lord Propry of this Province. These
are therefore to will and require as also strictly to charge and
Comand you the said Josias ffendall all excuses sett apart to
be and psonally appeare before his said Lspp: and his Councell
at Manahowicks Neck forthwith upon sight hereof to answer
unto such matters and things as shall be then and there
objected against you in behalf of his said Lspp, Whereof you
are not to faile as you will answer the Contrary at yor perill.
Given undr my hand this nine and Twentieth Day of Aprill
Anno 1679.

Ralph Smith p whom the abovesaid warrant was sent being
returned back again without executeing the same by reason
the said ffendall was not to be found the following ordr of
Councell was Directed to Capt Gerrard Slye viz.

Whereas this Day warrant issued from undr the hand of the
Honble William Calvert Esqr to summon Capt Josias ffendall
of Charles County to be and psonally appeare before his Lspp:
the Lord Propry & his Councell at Manahowickes Neck this
Day to answer unto such matters & thinges as should then
and there be objected against him on behalf of his said Lspp
wch said Warrant was sent by Ralph Smith to be served in
manner aforesaid, And fforasmuch as the said Ralph Smith
Did returne again wthout executeing the same by reason the
said ffendall was not to be found. And his said Lspp and his
Councell haveing just cause (both by the information of the
said Smith, and for severall other reasons) to suspect that the
said ffendal (conscious to himself of the matters alleadged
against him) doth willfully abscond himself. These are there-
