128 Proceedings of the Council of Maryland, 1676-1678.
Lib. R. R. Lopps Rule & Govermt the destruction of the peace of the good
people of this province & the very constitution of Assemblyes
which are the true preservers of the Liberties of the people &
the ffountaine of Our Lawes & justice, did endeavour to pub-
lish the same under the specious pretences of the preservation
of The Liberties of the ffreemen of this Province, though in
truth they tended to the Ruine of the ffreehoulders & house-
keepers of this Province & the takeing away of just liberty &
true propty in Our goods Lands & Tenemts & to that end did
On Sunday the third day of this instant September at the
Plantation of Thomas Barbary upon Petuxent River in Calvert
County aforesaid with fforce & Terror of Armes assemble
themselves with divers others to the number of sixty persons
by them seduced in a mutinous & Seditious manner to extort
from the Governour & Councell of this Province a grant of
the contents of that paper being certaine Imunityes & ffree-
domes not within the power of the said Governour & Coun-
cell nor of the Lord Propry himselfe to grant without the con-
sent of an Assembly And whereas the said Governour &
Councell did send to the said Wm Davyes and his Complices
at the time & place aforesaid Comanding them to lay
downe & yeild up their Armes & to retire to their owne
houses promiseing to propound their requests to the next
Assembly who alone could grant their petitions and in the
interim promised them all ffree pardon Wm Davyes only
excepted to whom they notwithstanding promised a ffree &
legall tryall at the Provinciall Court, and that they would not
in this case exercise Martiall Law as his case justly deserved.
And whereas these condiscentions of the Governour & Coun-
cell were then and there slighted & contemned by the said
Davyes, Gent, Hasleham & Pate & their Complices and that
they did from thence march away with drummes beateing &
Collours flying in despight and defiance of his Lopps Govrment
and to the Terror of all the good people of this Province
though they have since with drawne & dispersed themselves
& lye lurkeing till they can find a fitter Opportunity to worke
Out their wicked & malitious designes. These are therefore
by the advice of the Councell in the name of the Lord Pro-
prietary to declare publish & proclaime the said Wm Davyes
Wm Gent Giles Hasleham & John Pate mutinous and sedi-
tious persons Outfaceing all Lawes & justice with fforce and
armes & strictly to charge & comand all persons Inhabitants
of this province not only not to aide abett comfort or assist them
or any of them upon paine of being proceeded against as
mutinous & Seditious persons & punished with death accord-
ing to the Lawes of this Province but also strictly to require
p. 103 all persons that shall know where they or any of them are
