510Court and Testamentary Business, 1657.
Liber B. Sixty pounds of Tobacco and Caske as by Bill appcareth which, No. Bill was assigned unto William Marshall by Phillip Land, and
the Said Marshall Suing this Court for Satisfaction for the Said Debt, The Court doth order that the Said Smith Shall Satisfie the Said debt of 3 hundd and Sixty pounds of Tobacco and Caske unto the Said Marshall, with Cost of Suit, or Else Execution
Order to Patrick Forrest Upon the motion of Patrick forrest to this Court that a probat might be made of the wills of mr Thomas Hatton and mrs Hatton deceased, and in regard the Wittnesses Lives Something remote, whereby they Cannot Conveniently Come to the Court, The Court doth therefore order that the Said Forrest (being one of the overseers of the will of the Said mrs Hatton) Shall repair to mr John Hatch, or mr John Lawson, who is hereby Impowered to Summon Such Wittnesses before them, as can make proofe of the Deseasants Wills, and that returne thereof be made to the next Provinciall Court
James Jollyes Bill, to David Farrera Be it knowne unto all men by these presents that I James Jolly do bind my Self my heires, Assignes Executrs or Admin- istrators to pay or Cause to be paid unto David Farrera his heirs Assignes Executors or Admrs the full and JUSt Sume of one Thousand Six hundred pounds of Good Sound well Con- ditioned Tobacco and Caske without Ground Leaves to be paid at or before the 10th of October next Ensuing the date hereof, I Sett my hand this last of march 1657 Signum
Signed and Delivered & Sealed in the James I I lolly Signum prsence of us, Robert R T Taylor Giles Sadleir
p. 285 Be it knowne unto all men by these presents that I Iames Jolly do bind over my Cow and Calf, and heifer and my Crop unto David Farrera for the Said Tobacco Above-Mentioned, and in Case the Tobacco be not paid, I also bind over all moveable, and unmovcable Estate, which I will Confess in Court upon Demand, whereunto I Sett my hand this last of march 1657.
