            346 Court and Testamentary Business, 1653/4.

        

        

        

        Liber B.   john Domall plte Upon the defendants Petcon having attended

              Wiiim Ewens deft this Court upon an Arrest and none appearing

              to prosecute. It is ordered that the pite be Nonsuited and to

              pay the defendant two hundred pounds of Tobacco and Caske

              for his unjust Molestation, besides Court Charges.

        

                Upon the Motion of mr Phillip Land, It is ordered that the

              Warrant against Richard Recklesse for his appearance this

              Court, and the Arrest thereupon Stand Good for his appear-

              ance the Next Court.

        

                   To the Right Worll Capt Willm Stone Govr & the worll

                     Councill

                      The Humble Petition of William Ewens.

              Sheweth.

                That Whereas your Petitionr was Arrested unto this Court

              to be holden the tenth of January upon an Acon of the Case

              at the Suit of John Domali, and having given my diligent

              attendance to answer the Said Suit, and the pite having no

              ways prosecuted against your Petitionr Yor Petitionr humbly

              prayeth that the Suit may be dismissed and reparacons given

              unto yor Petitionr for his Losse of time and Expence, And your

              Petitionr Shall pray &c.

        

                    At a Court held at St Maries

                     the Sixt of March Ao 1653

        

                              William Stone Esq Governour

                             mr Thomas Gerrard

                              Capt John Price

                      Present

                             mr William Eltonhead

                             mr Robert Clarke

                             mr Thomas Hatton

        

                After the Governour and Counsell (present this day) had

              for Some time Sate in confutacon about Some affairs in relacon

              to the Publick Safty, the fell upon the hearing of Some par-

              ticular Causes as followeth viz.

        

                Upon the Mocon of Marks Pheypo, and a Suspicion appear-

              ing of an Intention in Coll ffrancis Yardley to remove his

              Estate out of this Province having Severall ingagements Upon

        

           550     him here, And the Said Colonell being Summoned to Appeare

              at the Court held the first of this Month to Answer the Said

              Pheypoe's Suit did not appeare at that Court nor any for him

              to Answer therein, It is ordered that mr Job Chandler be Im-

              powered, in case he find any probable intention or Endeavour
