To the right honourable the Lords of the Committee of Trade
and Plantations.

In obedience to your Lordships Order of reference of the
19th of September last I have considered of the severall de-
mands made by my Lord Baltemore in the Province of Mary-
land and represented to their Majties by the Assembly of that
Province and I have been attended by the Lord Baltemore
and his Councill; and as to his Lordships first demand of 12d
p hoggshead for all Tobacco exported out of that Province I
find the said duty is part of a certain duty of 2s a hogshead
for all Tobacco exported from that Province granted by an
Act of the Assembly there of 7th Mar: 71. one moiety whereof
is by the said Act appropriated to the publick service for the
better support of the Government and the other moiety (which
is the 12d a hogshead now demanded by the Lord Baltemore)
is thereby granted to the Lord Baltemore to be received by
him for his own use as Proprietor of the said Province and
that the said 12d a hogshead was by Order of Council the 26th
Feb: 90. directed to be answered and paid to the Lord Balte-
more as Proprietor of Maryland and I doe not find that the
Assembly doe much contest my Lord's right to this duty of
12d a hogshead in the Representation they have made to their
Majestyes, where they say they are with their Majtyes Royall
assent ready to confirm the same to his Lordship Provided his
Lordship grant the same conditions of Plantations he did before
the happy Revolution, or the same that their Majtiesdoe to the
Colony of Virginia, to the Inhabitants of that Province, but
what those conditions are it doth not appear to mee otherwise
than by looking into the said Act of the Assembly in 71. by
which the said duty was granted, I find that duty was granted
to the Lord Baltemore upon condition that his Lordship
should accept a pound of Tobacco in stead and in lieu of every
2d Rent, att any tyme reserved upon any grant of land made
by his Lordship which condition his Ldp affirms to mee he
always shall and still is ready to comply with.
2. As to the 2d demand of 14d p Tonn for all Tobaccos
exported out of that Province, I find that by an Act of the As-
sembly of that Province in 1661 it was enacted that all Ves-
sells whatsoever not properly belonging to that Province
having a Deck Flush forte and after comeing in and trading
within that Province, should pay for Port dutyes and Anchor-
age a pound of powder and three pounds of shott or so much
