       armes; & mustered them by Leift Sowth, & Peter Knight, in a Liber A.

       feild, called Kent feild & then proposed to them, to goe downe

       in warlike manner to assault, & take the Gour of Mary-Land,

       & the ffort att St Maries: Telling them, att the first, tht bee

       would goe wth them. Whereuppon the sd Company assented

       to goe wth him, perswaded by him, That bee had lawfull

       Authority thereunto. But after the embarkemt of some of the

       prouisions for this uoyage were putt aboard, some of the Inhabts

       before they would embarke themselues, desyred to bee made

       acquainted by him, wth the Authority tht should iustify them in p. 222

       the Sd Act. wch hee denying to shew the sd Inhabts drew of from

       the designe. After wch againe the sd Capt Cleyborne urged

       the Inhabts to goe uppon the foresd designe, wth his Cozen

       Tompson, who he sayd should leade them. & tht hee himselfe

       would carry them downe wth such Pinnaces as were there

       under his deposition for tht use, wch were three & would land

       them att Poynt Looke Out & would goe ouer to Chicacoan &

       send or fetch more helpe unto them. Wth the Inhabts againe

       refusing to doe about a day after the sd Cleyborne leauing the

       Iland embarked for Virginia. & ffurther hee sayth not.

         Decembr 9th This day came Capt Robt Vaughan, & humbly

       petitioneth the Gour to wthdraw his accon agst him: & acknowl

       edgeth before the sd Gour & other parties prnt, to haue diuers

       times reuyled the sd Gou wth scandalous & upbrayding speeches,

       uppon the Ile of Kent, where he bore the Command. As allso

       to haue sundry times in his discourse uppon the Sd hle, taxed

       the sd Gouernour wth Partiality of Justice. Wh sd fact he con

       fesseth to bee fowle, & rashly done by him, & alltogether false.

       And wthall humbly requyreth forgiunes for such his sd misde

       meanors herein; expressing sorrow therefore wth purpose of

       amendemt And desyreth tht bee may not be brought, to bee

       censured, as such his facts in this kind deserue.

         Whereuppon the Gour wthdrew his accon & pardoned the

       offence.

      

         Edw: Commins demandeth of Nicolas Browne 700 l Tob &

       cask being the one halfe of a iudgmt recouered agst him the Sd

       Commins, by George Manners, wch the sd Commins conceiueth

       to bee dew to him from the sd Browne, for tht bee was ioyntly

       & actually engaged wth him in tht busines, for wch iudgmt was

       recouered agst him.

         Wart to the Sheriffe of Kent ret. Jan Court next.
