                  350     Court and Testamentary Business, 1647.

             

              Liber A. to demand or receiue the Tob: of the sd Anthony & further he

                   sayth not                       Tho: Gerrard

                  Juratt coram me

                                 Tho: Greene

             

                  Att a Court prnt Vnto the demand of Willm Wheateley plf

                  Gouernor } agst ffrancis Anketill, & James Langworth

                  Gerrard     defts. for eight barrells of Corne due by Bill.

                  The deft acknowledgeth the Bill, but denyeth tht eur he receiued

                  consideraon for the sd Bill wch being proued by the oath of

                  the plf, tht he tendred deliuery of the Corne in the pnce of

                  Nicholas Harucy, & for want of a bb, could not make deliuery.

                  whereat Nicolas Haruey the master of the howse replyed, that

                  to his knowledge there was soe much Come in his loft. And

                  tht if there wanted, towards the prouision of the howse the sd

                  nicolas was to make it good. Whereuppon the defts accepted

                  of the Corne wthout further measure. Ordered by the Court

                  tht the plf should recover.

             

             p. 107 Vppon the demand of Cuth: ffenwick Gent. Attorney of

                  Capt Thomas Cornewalleys. Plf. agst Jno Hampto deft. The

                  deft acknowledgeth the debt. Ordered that the plf should

                  recour 1445 l & cask, due by Bill. And 350 l Tob. & cask due

                  uppon acct

             

                    Vppon the demand of Jeoffrey Power plf agst Mrs Marg:

                  Brent deft the deft not denying the demand of three hundd &

                  fifty pownds of Tob: to be due to the plf, out of the Leuy. The

                  Court ordered tht the deft should assigne soe much to the plf,

                  out of the Leuy.

                    And for the other part of the demand, concerning a Steere

                  the deft sayth tht Mr Caluert did promise to repay the sd Steere

                  wth another out of his stock: And tht shee not hauing

                  his stock att desposall, is disinabled to make it good.

                    Concerning the steere respited till next Court.

             

                    Whereas on the fift of January last, there was a sequestraon

                  granted unto Tho: Greene Esqr of the estate of Dr George

                  Binks, late of this Prouince, to the value of eight hundd forty

                  nine pownds of Tob: & cask to be responsable for a demand

                  of soe much due to the sd Thomas Greene, from the sd Dr

                  Binks. I Jno Hatch Sheriffe doth hereby acknowledge to haue

                  exequeted the sd Sequestraon by the appraysmt of one Cow,

                  belonging to the sd D' Binks By two sworne appraysors Viz

                  Barnaby Jackson & Henry Adams. & rated att six hundd

                  pownds of Tob: And allso a Steere 2 yeares old & advantage

                  praysed by other two sworne appraysors Viz Henry Adams &
