Court and Testamentary Business, 1647. 323
July 28th Ordered this day by the Gouernor tht Mr Bretton Liber A. Register of the Court, shall haue power in case of absence of the Gouernor or other urgent occasions, to signe writts, or warrts under the Governors name.
July 28th Richard Span, att the request of John Prichiard sayth uppon his oath tht hee the sd Richard Span receiued a hogshead of Tob: of the sd Jno Prichiard att the lie of Kent somtime in Nouembr last to transport it downe into Virginia & to land it, in Capt Cleybornes store att Kicotan, wth order from the sd Jno Prichard to make use of the sd Tob: if he pleased, & to pay another hogshead unto the sd Prichiard, when hee should demand it. Afterwards Peter Knight came to this Dept & affirmes tht bee had had order from the sd Jno p. 81 Prichiard to receiue the foresd hogshead of Tob: And further this Dept sayth tht he the sd Peter Knight tooke the sd hogs- head of Tob: out of the store & did dispose of it to his owne proper use. & further he sayth not. Coram me Tho: Greene
July 28th Tho. Greene Esqr demandeth of Richard Span a fowling Gunne wch he deteyneth from him. To the ualue of 300 l Tob: & cask. Warrt to the Sheriffe to keepe the sd Span in safe custody untill he shall putt in security to bring forth the sd gun some time before the first of Nouembr next.
This day came Richard Spanne, & confessed himselfe in debted unto Tho: Greene Esqr in the full summe of 300 l of Tob: & cask in case he shall not bring forth a fowling gunne belong ing to the 3d Tho: Grccnc & tcndcr it, att S Inego's ffort, somtime before the first of Nouember next. July 31th Thomas Jackson att the request of John Harwood sayth uppon his oath tht Leon: Caluert late Gouernor deceased killed a Cow of the sd Harwoods & for the use of the ffort; & was by bargaine to deliuer him another Cow for it. Stanop Roberts deposeth the same.
Aug 3d Memorandum tht I Cuth. ffenwick Gent. Attorney of Capt Tho: Cornwalleys doe hereby & by these prnts acquitt & discharge Jno Pyle from debt of Twelve hundd pownds of Tob: & Cask due unto the sd Capt Cornewalleys by specialty. The sd summe being due for the freight of his cattle from Accomack. Wittnes my hand. Cuth: ffenwick Recognte Teste me Willm Bretton Clk.
