322 Court and Testamentary Business, 1647.
Liber A. it not; for he cared noe more for the Gouernoure (meaning Mr Greene) then hee did for any of the rest. Aliso att the same time speaking concerning Capt Hill; hee wished tht Capt Hill would come, & reassume the gouermt affirming tht if Capt Hill were come, & tht hee the sd James Johnson could see Capt Jno Price, pressing soldiers, to resist the sd Capt Hill, & not aboue two others in his Company hee would shott him (meaning Capt Price) All wch being proued by the Oath of Rich: Bennett, the Court iudged tht hee should be fyned in 2000 l Tob: & to bee whipped wth 30 lashes. And to remaine in the sheriffes hands, till the Corporall punishmt be exequuted. & to putt in security for the paymt of the sd ffyne. warrt to the sheriffe to see the sentence exequuted to morrow in the euening.
July 15th Came Rich: Bennett, & deposed, sayth tht hee goeth in danger of his life for tht James Johnson hath threatned him wth speeches to tht purpose. protesting tht whosoeur shall relate any speeches uttered by the sd Johnson, tht he the sd Johnson will giue him a Rogues mark &c: And desyreth tht the sd James Johnson be bownd to the peace & good behavior
p. 80 July 28th Willm Lewis demandeth attatchmt for a boate wch the sd Lewis claymeth to be his, wch sd Boate was brought hither by Mr Tho: Pasmore of Chicacoan. Wart to attatch the sd boate & to deliur the same unto the sd Willm Lewis, in case the sd Tho: Pasmore shall not deny the claime. But if hee shall deny, to bring the sd Tho: Pasmore before the Governor forthwth to shew cause &c: Att a Court Vnto the demand of Willm Lewis, Mr Pasmore prnt Gouernor sayth, tht he knoweth nothing concerning the foresd claime: for tht he borrowed the sd boate of one Henry Moseley of Chicacoan only for his prnt transport to St maries about his owne affayres. Charles Maynord deposed sayth uppon his oath to the best of his remembrance tht the Boate wch the sd Lewis layth claime to, was formerly Mr Lewis his boate as appeareth by marks, to witt a poplar thoate, being the fore thoate a flatt bottome & a broad sterne. Thomas Howard deposeth idem. Ordered by the Gouernor tht iudgmt be respited untill the Tenth day of August, before wch time the foresd Henry Moseley is to appeare by himselfe, at his Attorney att St Inego's ffort to make answere to the sd claime of Willm Lewis or else iudgmt to proceed as confessed for not appearance,
