Charter Amendment - Personnel
A RESOLUTION proposing an amendment to the Charter to permit
classified employees to organize and bargain collectively
through representative employee organizations; repeal and
amend certain provisions pertaining to the merit system; to
amend certain provisions pertaining to the Personnel Officer
and the Personnel Board; and adopting a certain question
pertaining to this Charter amendment to be voted on at the
General Election in November, 1988.
WHEREAS, in Griffith v. Wakefield, 289 Md. 381 (1984), the
Court of Appeals stated the principle that a county charter
is like a local constitution, intended to establish the
framework of government, and that procedural matters are
left to the legislative body; and
WHEREAS, numerous provisions of Article VIII - Personnel of
the Charter are procedural and therefore legislative in
nature, going beyond the establishment of the form and
structure of government; and
WHEREAS, it is therefore necessary to remove certain
personnel provisions from the Charter, so that they might be
established legislatively rather than by the electorate;
now, therefore,

Charter Amendment - Administrative Hearing Officer
A RESOLUTION proposing an amendment to the Charter to rename the
Office of Zoning Hearings and the Zoning Hearing Officer to
the Office of Administrative Hearings and the Administrative
Hearing Officer, respectively; to impose certain duties on
the Administrative Hearings Officer, and adopting a certain
question pertaining to this Charter amendment to be voted on
at the General Election in November, 1988.
