Baltimore County                                2601

has obtained a license in any county or municipality under the
Grandfather clause without examination, shall not be granted a
license without examination, until he has successfully conducted his
or their business for at least
[one] two [year] years in that county
or municipality after receiving said license and has furnished verifica-
tion in writing from that county or municipality.

Section 4. And be it further enacted, That this Act shall take
effect forty-five days after its enactment.

Enacted: February 8, 1971.

BILL NO. 18

AN ACT to empower any judge in Baltimore County, exercising
jurisdiction in any juvenile cause, to award a judgment against a
parent for acts of wilful or malicious destruction or theft of
property committed by the minor child of such parent, including
the power to cite such parent for contempt and to provide for
restitution by such minor child, by adding new Section 18-23 to
the Baltimore County Code, 1968, Title "Offenses-Miscellaneous".

Section 1. Be it enacted by the County Council of Baltimore
County, Maryland,
that new Section 18-23 be and it is hereby added
to the Baltimore County Code, 1968 Title "Offenses-Miscellaneous";
said new section to read as follows:

Section 18-23. Judgment against parent of minor who destroys or
steals property; restitution.

Any judge in Baltimore County having, sitting, and exercising
jurisdiction in any juvenile cause, lawfully before him, shall, in his
discretion, have power to award a judgment in favor of a wronged
person and against any parent for acts of wilful or malicious de-
struction or theft of any property owned by such wronged person,
caused or committed by the minor child of such parent, or such
judge may order such parent to make restitution to the person whose
property has been so destroyed or stolen and shall have full power
to cite for contempt for a violation thereof if the facts of a particular
case before him indicates sufficient ability of such parent to comply
with such order. The court may pass an appropriate order requiring
such minor child who wilfully or maliciously destroys or steals
property to make restitution himself if such is feasible considering
the age and circumstances of the child, and the requirement of the
child's making restitution shall precede any liability of the parent
hereunder.

Section 2. And be it further enacted, that this Act shall take
effect forty-five days after its enactment.
