159.

(a) Establishment.—There is hereby constituted and established
in each county a Liquor Control Board, to be appointed and to have
the tenure, compensation, powers and duties as provided in this sub-
title; provided that in Montgomery County there is hereby consti-
tuted and established, effective July 1, 1951, a Department of Liquor
Control, which shall be a department of the county government under
the general supervision of the [county manager} Chief Administra-
tive Officer,
and which shall have the powers of a Liquor Control
Board as defined in Section 163 of this subtitle. Whenever used in
this subtitle the words "Liquor Control Board" or "board" shall be
construed to apply to the Department of Liquor Control in Mont-
gomery County whenever such construction would be reasonable.

(c) Appointment.—The members of the respective boards shall
be appointed by the Governor with the advice and consent of the
Senate. Provided, that in Somerset County they shall be appointed
by the Governor. In Harford County they shall be appointed by the
Board of County Commissioners. In Garrett County, the members of
the board shall be appointed by the Governor. He shall appoint two
members of the board who are members of that political party which
has elected a majority of the members of the Board of County Com-
missioners and one member of the board from that political party
other than the one electing a majority of the Board of County Com-
missioners. The appointments shall be confirmed by the House of
Delegates if there is no resident Senator elected from the county.
In Kent County the County Commissioners shall be ex officio mem-
bers of the Liquor Control Board. In Garrett and Harford Counties
said board shall also be known as the Board of License Commission-
ers of these respective counties, upon which shall be devolved all the
duties and rights given elsewhere in this Article. In Montgomery
County, the Director of the Department of Liquor Control shall be
appointed and removed by the County [Manager] Executive with
the approval of the County Council. In Montgomery County there
shall also be an advisory board which shall consist of three members
who shall be appointed and removed by the [Montgomery County
Council] County Executive with the approval of the County Council.
All members shall be residents of Montgomery County, and of the
three members, one shall be a bona fide holder of a liquor license in
Montgomery County. Of the other two members, one shall be a mem-
ber of one of the two major political parties in the State, and the
other of the opposite major political party in the State. The members
of said board shall receive no compensation, but shall be entitled to
necessary expenses in connection with their duties. Of the members
first appointed, one shall serve a term of two years from June 1, 1967,
one shall serve a term of three years from June 1, 1967, the third
shall serve a term of four years from June 1, 1967, and their succes-
sors shall fill the unexpired portion of the term or four years for such
new term as the case may be. The advisory board shall report to the
[County Council] County Executive periodically but at least semi-
annually on recommendations for the improvement of the operations
of county liquor dispensaries from the standpoint of efficiency,
profit and convenience to the consumers. If there is no resident
Senator from Caroline County in the Senate of Maryland at the time
of the appointment, the appointment in that county shall be with the
advice and consent of the House of Delegates of Maryland.
