CHAPTER 469
(House Bill 338)

AN ACT to repeal and re-enact with amendments Sections 150(c),
156(b), 159(a), 159(c), 159(f), 159(h)(4), 161(d), 163(k) and
165(e) of Article 2B of the Annotated Code of Maryland (1968
Replacement Volume and 1968 Supplement), title "Alcoholic Bev-
erages," subtitles "Boards of License Commissioners" and "County
Liquor Control Boards and Dispensaries"; to authorize the County
Executive in Montgomery County to appoint and remove the mem-
bers of the Board of License Commissioners with the approval of
the County Council; to provide for the supervision of the Depart-
ment of Liquor Control by the Chief Administrative Officer; to
authorize the County Executive to determine the qualifications of
the Director of the Department of Liquor Control, to appoint,
remove and fix the compensation of the Director of the Depart-
ment of Liquor Control, and to appoint and remove the members
of the Advisory Board on Liquor Dispensaries with the approval of
the Council; to authorize the Director of the Department of Liquor
Control with the approval of the County Executive, to determine
the locations for county liquor dispensaries and to acquire real or
personal property for the dispensaries, stores or warehouses; and
to delete an obsolete reference to approval by the County Manager
of the amount of the revolving fund for operation of the dispensary
system.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 150(c), 156(b), 159(a), 159(c), 159(f), 159(h)(4),
161(d), 163(k) and 165(e) of Article 2B of the Annotated Code of
Maryland (1968 Replacement Volume), title "Alcoholic Beverages,"
subtitles "Boards of License Commissioners" and "County Liquor
Control Boards and Dispensaries," be and the same are hereby re-
pealed and re-enacted, with amendments, to read as follows:

150.

(c) Montgomery County.—In Montgomery County, on July 1,
1951, the County Council shall appoint three persons who shall con-
stitute the Board of License Commissioners for said county. One of
the members appointed to the first board shall serve for two years;
another shall serve for four years; and the third shall serve for six
years. At the expiration of each of the above terms, appointments or
reappointments shall be for six-year terms. On and after December
7, 1970 all appointments or reappointments shall be made by the
County Executive subject to the confirmation of the County Council.
No more than two members of said board shall belong to the same
political party.

156.

(b) Boards appointed by County Commissioners.—The Board of
County Commissioners may remove any member of any Board of
License Commissioners appointed by them, for the causes in this
section prescribed. In Montgomery County, the County Executive
may, with the approval of the County Council, remove any member
of the Board of License Commissioners for the causes in this section
prescribed.
