before it approves or constructs such project, such contribution to be
paid in cash before construction begins or secured to the satis-
faction of the Commission; and said Commission may construct any
part of any approved drainage project, provided the person or com-
pany interested contributes not less than one-half of the cost thereof.
After June 30, 1968 in Montgomery County, except for that portion
of the City of Takoma Park now situated in Montgomery County, the
said county may construct any part of any approved drainage project,
provided the person or company interested contributes such share
of the cost thereof as is deemed proper by said county. In Mont-
gomery County the Director of the Department of Public Works shall
include in his annual submission to the County [Manager] Executive
of his estimates of capital projects to be undertaken, a request for
an appropriation to provide sufficient funds for anticipated contri-
bution drainage projects.

71-45 (83-96).

(a) Commission's six-year capital improvements program of
water and sanitary sewerage facilities. Prior to October 1st of each
calendar year, the Commission shall prepare and submit to the
governing body of each county in the Sanitary District and the
County Executive of Montgomery County
a six-year projected pro-
gram of capital improvements with respect to water and sanitary
sewerage facilities, the same hereinafter being referred to as the
Commission's capital improvements program. The Commission's
capital improvements program shall include a statement of the
objectives of the several projects or individual programs therein
and their relationship to the long-range development plans of the
respective county governing bodies, as the same shall have been
designated to the Commission by the county governing body. The
Commission's capital improvements program shall, for each project,
show a projected construction schedule, an estimate of cost, and a
statement of funding sources, including contributions which may be
required for the effectuation of a project. The Commission's capital
improvements program shall include for each major water and sewer
project, the information and documentation for the six-year period
therein covered which it is required to submit, to the date of the
capital improvements program, under the provisions of Section 387C
of Article 43 of the Annotated Code of Maryland concerning 10-year
water and sewerage programs. In Montgomery County, the County
Executive shall submit his recommendations with respect to the
Commission's proposed program (including any suggested amend-
ments, revisions or modifications) to the County Council as an
integral part of the comprehensive six-year capital improvements
program required by the Charter for Montgomery County.
As used
herein the term "county governing body" shall mean the County
Council for Montgomery County and the Board of County Com-
missioners for Prince George's County or such governing body for
each county, respectively, as may be provided by law or instrument
of Charter, if adopted, and the requirements or responsibilities
stated in this Section 71-45(83-96) of the county governing body
shall be performed by the branch or branches of such overall county
governing body as may be provided by such other law or charter.

Sec. 2. And be it further enacted, That this Act shall take effect
on December 7, 1970.
