County, creating a County Roads Board, and a County Roads
Engineer, providing for their pay and duties, and relating generally
to roads in Somerset County

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 371 to 380A, inclusive, of Article 20 of the Code of
Public Local Laws of Maryland (1930 Edition), title "Somerset
County", sub-title "Roads", be and the same are hereby repealed,
Sections 372 and 378, respectively, having been amended by Chapters
349 of 1951, and 699 of 1939, respectively, and Sections 375A and
380A, respectively, having been added by Chapters 179 of 1941, and
58 of 1947, respectively; and that new Sections 371 to 380E, inclu-
sive, be and the same are hereby enacted, in lieu thereof, to stand
in the place and stead of the sections so repealed, to read as follows:

371.   The County Roads Board for Somerset County is hereby
created, and the Board of County Commissioners of Somerset County
is hereby constituted the County Roads Board. The County Roads
Board is to enter upon its duties and assume the responsibilities and
powers herein and hereinafter conferred upon the County Roads
Board on June 1, 1959.

372.   On and after June 1, 1959, as herein provided, the County
Roads Board has control over the public county roads, bridges, drains,
water courses, public landings, culverts, and curbs and gutters along
the same, in Somerset County and thereafter the County Roads Board
for Somerset County has control and regulates them.

373. The County Commissioners of Somerset County are author-
ized, empowered and directed at the time of making their annual
levy to levy such amount annually as in their opinion is necessary
for the building, repairing, reconstruction, maintenance and regu-
lation of the use of the public roads, bridges, drains, water courses,
public landings, culverts, and curbs and gutters along the same in
Somerset County, and for the purchase and maintenance of equip-
ment and for the purchase or rental of land or buildings to be used
for that purpose. The money so levied is designated "For construc-
tion, reconstruction and maintenance of County roads, bridges,
drains, water courses, public landings, culverts, curbs and gutters
and purchasing and renting of equipment, land and buildings in
connection therewith", but no part thereof shall be earmarked by
the County Commissioners for specific purposes, all such authority
to so earmark being vested in the County Roads Board. All monies
so levied and received are to be deposited by the County Treasurer
in a special fund for that purpose and paid out of that fund by the
County Treasurer on requisition of the County Roads Board. Any
unexpected surplus remaining in this account at the end of any year
may be carried over and used by the County Roads Board in future
years to carry out the purposes of this sub-title or may be used on
account of the costs of the succeeding year's roads program. Title
to any land, buildings or equipment purchased by the County Com-
missioners of Somerset County or by the County Roads Board for
Somerset County shall be and remain in the County Commissioners
of Somerset County, Maryland.

374. The members of the County Roads Board for Somerset County
shall each receive, in addition to their compensation as County
