(cc) (Violating any of the provisions of this Article.)

"Violating any of the provisions of this Article" includes failing,
neglecting or refusing to comply with any provision of this Article,
or with any effective and outstanding action, direction, ruling, order,
rule, regulation, or decision of the commission.

(dd) (Water Company.)

"Water Company" includes any public service company which
owns any water plant, and which sells, distributes or supplies water
for gain.

(ee) (Water Plant.)

"Water Plant" means the plant owned by a water company and
includes buildings, canals, dams, easements, real estate, water falls,
water power station or water supply.

SUBTITLE II—PUBLIC SERVICE COMMISSION

3.    (Commission Established.)

The Public Service Commission is hereby established as the agency
to administer this Article, and to carry out fully and effectually the
functions committed to it by law.

Officers

4.    (Oath.)

Each commissioner, the General Counsel to the commission, and
the People's Counsel shall, before entering upon the duties of their
respective offices, take and subscribe to the Constitutional oath of
office.

Commissioners

5.    (Membership of Commission.)

The commission shall consist of three commissioners, appointed by
the Governor. Each commissioner must be at least 25 years of age,
must be a registered voter resident in Maryland when he is appointed
and when he qualifies, and must have been a resident of Maryland
for at least five years next preceding his appointment. The governor
shall designate one of the commissioners as chairman, and the chair-
man shall serve in that capacity until expiration of his term as com-
missioner. Commissioners shall be eligible for reappointment.

6.    (Tenure.)

The term of each commissioner shall be six years from the expira-
tion of his predecessor's term. A commissioner shall continue in office
after his term expires until his successor has qualified, but without
lengthening his successor's term. Vacancies shall be filled by the
governor for the unexpired term.

7.    (Compensation.)

The compensation of the chairman shall be nine thousand dollars
($9,000.00) per year and that of each of the other commissioners
shall be eight thousand dollars ($8,000.00) per year.
