8. (Removal)
The Governor may remove any commissioner for incompetency
or misconduct in office, in accordance with the procedure set forth
in Article 41, sections 53-55.
Secretary
9. (Appointment and compensation.)
The commission shall appoint a secretary, who shall receive such
compensation as may be provided in the budget.
10. (Duties.)
The secretary shall have the following duties:
(1) He shall be the chief administrative officer of the commission
and shall carry out the commission's orders and policies.
(2) He shall keep the records of the commission, including a full
and true record of its proceedings, all documents required to be filed
by law or ordered filed by the commission, all orders, rules, rulings,
regulations and decisions of the commission, and all the commission's
dockets and files, and shall certify true copies thereof.
(3) He shall designate one of the employees of the commission to
perform the duties of secretary in his absence.
(4) He shall perform such other duties as the commission may
prescribe.
General Counsel
11. (Appointment, qualifications, tenure, compensation.)
The General Counsel of the commission shall be an attorney at law
of this State, and shall be appointed by the Governor upon the recom-
mendation of the commission. His compensation shall be fifty-five
hundred dollars ($5500.00) per year. His term of office shall be six
years, and he shall be eligible for reappointment. Vacancies shall be
filled for the unexpired term in the same manner as original appoint-
ments are made. He may be removed by the Governor for the same
reasons, and in the same manner as commissioners.
12. (Functions.)
The General Counsel shall have the following powers and duties,
subject to the order of the commission, which in its discretion may
substitute any other agent or instrumentality:
(1) He shall represent and appear for the commission in all pro-
ceedings to which the commission is a party, or may desire to inter-
vene, or which involve any question under this article, or involve any
act, order or proceeding of the commission.
(2) He shall advise the commission, upon request, in regard to
any legal questions requiring interpretation of this article or any
other provisions of law respecting the jurisdiction, rights, duties and
powers of the commission.
(3) Generally, he shall perform all duties and services as attorney
and counsel to the commission which the commission may reasonably
require.
