Said bill was then returned to the House of Delegates.
Senate bill entitled an Act to repeal Section 46, sub-Sec-
tion 1, of the Acts of 1872, chapter 346, entitled an Act to
repeal Sections 46, 47, 55 and 56, of Article 75, of the Code
of Public General Laws, entitled "Pleading, Practice and
Process," also, Chapter 420, of the Acts of 1870, entitled
an Act to amend the 3rd Section of the 75th Article of the
Code of Public General Laws, relating to "Pleading, Prac-
tice and Process," by substituting the following in lieu
thereof, and re-enact the same with amendments.
Being upon its second reading,
Mr. Sulivane submitted the following amendments:
AMENDMENTS PROPOSED.
1. In line 11, leave out words from the word "as" to the
word "wife," in line 12, inclusive, and insert the following,
viz:
"If defendant, and her husband, or some next friend, if
plaintiff, and botb husband and wife, or wife and next friend,
as the case may be.
2. In line 19, between the word plaintiff and the semi-
colon, insert the following, viz:
"Which damages shall be laid to cover the injuries sus-
tained by the plaintiff, and his mesne profits."
3. In line 21, omit the word "the" before land, and insert
the following, viz: "Set up on the."
4. In line 27, after the word "and," and before the words
"the land" insert as follows, viz: "Set up on."
5. In line 39, after the word "pleadings," and before the
semi-colon, itsert the word "other than the plea of not
guilty."
6. In line 44, after the word "case," insert as follows:
"Including any damages or mesne profits the plaintiff
could by separate action recover of the representatives of the
ancestor, which shall be specially found, and the defendant
shall be entitled to receive reimbursement therefor from the
personal estate of the ancestor, if not closed, and if closed,
contribution from his co-representatives to the extent of as—
