Anno Domini 1748 Aderton when thereunto afterwards he should be Requested well and truly would Content and Pay Nevertheless the afs.d Moses his Promise and Assumption afs.d not Regarding but minding and fraudulently Intending the same Jeremiah Aderton in this Part craftily and Subtilly to deceive and defraud the afs.d Moses Drape the said Sum of Eighteen Pounds Virginia Currency of the Value of Twenty Eight Pounds Sixteen Shillings Maryland Curr.y or any Part thereof to the same Jeremiah hath not paid nor him for the same in any sort Contented altho' the afs.d Moses Drape afterwards to wit the first day of December In the year of our Lord one Thousand Seven Hundred and forty Eight and often afterwards at Charles County afs.d by the same Jeremiah Aderton hath been Requested but the same to him hitherto to Pay or him for the same in any sort ^to^ Content hath altogether Refused and Still doth Refuse to the Damage of the same Jeremiah Aderton Thirty Six Pounds Virginia Currency of the Value of Fifty Seven Pounds Twelve shillings Maryland Currency and therefore suit is brought & so forth John Doe Pled.s &C.a & Rich.d Roe D.r Capt.n Moses Drape 1748 Per Contra C.r
Whereupon into Court here in his Proper Person Comes William Eilbeck of Charles County Merchant and becomes Pledge and Security for the said Moses that if it should happen that the s.d Moses in the plea afs.d should be Convict that then the said William Yeilded and Granted that as well the Damages afs.d as well Costs which to the said Jeremiah Aderton in this Part should be adjudged of his Lands & Chattles should be made and Levied to and for the use of the said Jeremiah Aderton that if it should happen that the said Moses the Damages and Costs afs.d to the said Jeremiah Aderton should not Pay or his body into the Custody of the sheriff by Reason thereof Render And now here at this day to wit the Second Tuesday in March afs.d Comes here as well the said Jeremiah Aderton by his attorney afs.d and the said Jeremiah Aderton by his said attorney prays that the said Moses to his Declaration afs.d against him may answer and the afs.d Moses by Thomas Clark his attorney afs.d Comes and defends the force and Injury when & so forth (And) |
