(298) March Court Anno Domini 1748
Charles County ss.t James Nelson and Richard Higgins late of Charles County Planter was attached to answer unto William Skyrin of a plea of Trespass upon the Case & so forth And Whereupon the same William by Jeremiah Chase his attorney Complains that whereas the said James and Richard after the first day of May in the year of our Lord one Thousand Seven Hundred and five (to wit on the Thirteenth day of November In the year of our Lord One Thousand Seven Hundred & forty Seven at Charles County afs.d did make their Certain Note in Writing Called a Promisary Note with their Proper Names hands and mark of them the said James and Richard thereto Subscribed Bearing date the same day and year last mentioned and the said Note unto the said W.m at the County afs.d did deliver by which said Note the said James and Richard Promised to pay Three Months after date of the said Note Joyntly and Seperately to William Skyrin or his order the full & Just Sum of Sixteen Pounds Thirteen shillings and Eight Pence Current money of the Colony of Virginia of the Value of Thirty Three Pounds seven shilling and four Pence Maryland Currency for Value Received by Virtue whereof and also by force of the statute the said James and Richard became Liable and Chargeable to Pay unto the said Wm Skyrin the said sum of Sixteen Pound Thirteen Shillings and Eight pence Virginia Currency according to the Tenor of the Note afs.d and so being Chargeable the said James and Richard afterwards to wit the day and year last mentioned at the County afs.d upon themselves Assumed and to the said William then and there faithfully Promised that they the said James and Richard the said sum of Sixteen Pounds Thirteen Shillings and Eight Pence Virginia Currency of the Value of Thirty Three Pounds seven shillings and four Pence Maryl.d Currency to the said William when thereunto afterwards they should be Requested well & truly would Content and Pay Nevertheless the said James and Richard their Promise and Assumption afs.d not in the least Regarding but minding and fraudulently Intending the same William In this Part craftily and Subtilly to deceive and defraud the said sum of Sixteen Pounds Thirteen Shillings and Eight Pence Virginia Currency of the Value of Thirty Three Pounds seven shillings and four Pence Maryland Currency or any part thereof to the s.d William hath not Paid altho so to do the said James and Richard was on the sixth day of (October) |
